PRIVACY STATEMENT |
episode49, LLC is dedicated to protecting the privacy of visitors to ContinuTrac.com.
We value your trust and make every effort to ensure that any information obtained
about our users and visitors is private, confidential, and secure. To ensure your
privacy, we disclose our information practices when possible before receiving information.
This policy applies only to the sites maintained by episode49, LLC and not third
party links to which ContinuTrac.com may link.
episode49, LLC only collects names, addresses, e-mail addresses, and other such
information under voluntary consent of the visitor who wishes to have episode49,
LLC contact him or her. Such information will not be shared with other organizations
for commercial purposes. You will only receive email from us if you have requested
it.
EXCLUDED PROVIDER
episode49, LLC hereby represents and warrants that episode49, LLC is not and at
no time has been excluded from participation in any federally funded health care
program, including Medicare and Medicaid. episode49, LLC hereby agrees to immediately
notify Client of any threatened, proposed, or actual exclusion from any federally
funded health care program, including Medicare and Medicaid. In the event that episode49,
LLC is excluded from participation in any federally funded health care program during
the term of this Agreement, or if at any time after the effective date of this Agreement
it is determined that episode49, LLC is in breach of this Section, this Agreement
shall, as of the effective date of such exclusion or breach, automatically terminate.
CONFIDENTIALITY
- Definition. “Confidential Information” means any information or data (including
without limitation any formula, pattern, compilation, program, device, method, technique,
or process) that is disclosed by one Party (a disclosing Party) to the other Party
(a receiving Party) pursuant to this Agreement. Confidential Information does not
include information that: (a) is or becomes publicly known or available without
breach of this Agreement; (b) is received by a receiving Party from a third Party
without breach of any obligation of confidentiality; or (c) was previously known
by the receiving Party as shown by its written records.
- Confidentiality Obligations. A receiving Party agrees: (a) to hold the disclosing
Party’s Confidential Information in strict confidence; and (b) except as expressly
authorized by this Agreement, not to, directly or indirectly, use, disclose, copy,
transfer or allow access to the Confidential Information. Notwithstanding the foregoing,
a receiving Party may disclose Confidential Information of the disclosing Party
as required by law or court order; in such event, such Party shall inform the other
Party via telephone, email, or facsimile, with the receiving parties acknowledgement
prior to any such required disclosure.
This policy is applicable to ContinuTrac.com only. We reserve the right to change
the policy at any time without prior notice. |
